text-align\">Classification <\/h3>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Immediate Impact <\/h2>\n<p>\u201cThe immediate impact of the regulations is that workers are more likely to be classified as employees than as independent contractors,\u201d Jerry Cutler, co-chair of the American Bar Association\u2019s Section of Litigation, Employment and Labor Relations Law Committee and lead author of <em>Legal Guide to Human <\/em>Resources, said via email.<\/p>\n<p>\u201cThe immediate impact of the regulations is that workers are more likely to be classified as employees than as independent contractors,\u201d Cutler, a lecturer at Columbia University School of Professional Studies, observed.<\/p>\n<p>He said this means:<\/p>\n<ul>\n<li>\u201cPotential cost increases to companies in meeting the minimum wage and overtime requirements of the federal Fair Labor Standards Act and [paying the ]payroll taxes for Social Security and Medicare.\u201d<\/li>\n<li>\u201cWorkers are likely to become eligible for \u2018employee only\u2019 benefits such as retirement, health insurance, unemployment insurance and workers\u2019 compensation.\u201d<\/li>\n<\/ul>\n<h2 class=\"subhead-embed color-accent bg-base font-accent font-size text-align\">Begin Auditing Activities Of Freelancers <\/h2>\n<p>Companies are \u201cwell-advised to begin auditing the work activities of their independent contractors to determine whether they meet the requirements of the proposed regulations,\u201d Cutler recommended.<\/p>\n<p>He said the requirements include:<\/p>\n<ul>\n<li>The degree of control exercised by the company over the worker<\/li>\n<li>The worker\u2019s opportunity for profit or loss<\/li>\n<li>The permanency of the relationship between the worker and the company<\/li>\n<li>Whether the work performed is an integral part of the company\u2019s business<\/li>\n<li>The worker\u2019s investment in equipment or materials required for their work<\/li>\n<li>The skill and initiative required to perform the work<\/li>\n<\/ul>\n<p>\u201cUnder the proposed regulations, all of these factors are considered, and no individual factor has a greater weight in determining whether the worker is an independent contractor,\u201d Cutler concluded.<\/p>\n<h2 class=\"subhead-embed
