{"id":21762,"date":"2022-07-03T18:12:17","date_gmt":"2022-07-03T18:12:17","guid":{"rendered":"http:\/\/egrowonline.com\/?p=21762"},"modified":"2022-07-03T18:12:17","modified_gmt":"2022-07-03T18:12:17","slug":"new-court-ruling-may-tie-secs-hands-on-crypto","status":"publish","type":"post","link":"http:\/\/egrowonline.com\/?p=21762","title":{"rendered":"New Court Ruling May Tie SEC&#8217;s Hands on Crypto"},"content":{"rendered":"<p> <br \/>\n<\/p>\n<div id=\"pymnts-content1342710\">\n<p>Securities and Exchange Commission (SEC) Chairman Gary Gensler\u2019s ongoing regulatory campaign against the cryptocurrency industry he calls \u201cthe Wild West of finance\u201d may have just run into trouble at the Supreme Court.<\/p>\n<p>While the 6-3 ruling was on a case involving the Environmental Protection Agency\u2019s (EPA) ability to regulate air pollution, the court remanded a regulation that would cap carbon dioxide emissions at a level that would drastically reduce the amount of coal-powered electricity to a federal appeals court.<\/p>\n<p>But the court\u2019s majority opinion in <a target=\"_blank\" href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\" rel=\"noopener noreferrer\">West Virginia v. EPA<\/a> was broad enough that it could drastically curtail the way agencies like the SEC exert their regulatory authority outside of congressional control.<\/p>\n<p>This may well have an impact on the cryptocurrency industry, which is being regulated by agencies that are trying to force it into an existing set of regulations that it does not fit, crypto industry advocates have been arguing for years.<\/p>\n<p>\u201cToday\u2019s #SCOTUS decision challenges the regulation by enforcement approach that the digital asset industry has been forced to navigate,\u201d Perianne Boring, CEO of the Chamber of Digital Commerce, a crypto industry association, <a target=\"_blank\" href=\"https:\/\/twitter.com\/PerianneDC\/status\/1542602434119438338\" rel=\"noopener noreferrer\">said<\/a> on Twitter. \u201cWithout clear Congressional authorization, federal agencies must tread carefully.\u201d<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Today&#8217;s <a target=\"_blank\" href=\"https:\/\/twitter.com\/hashtag\/SCOTUS?src=hash&amp;ref_src=twsrc%5Etfw\" rel=\"noopener\">#SCOTUS<\/a> decision challenges the regulation by enforcement approach that the digital asset industry has been forced to navigate. Without clear Congressional authorization, federal agencies must tread carefully. <a target=\"_blank\" href=\"https:\/\/t.co\/6iFcaTPAHt\" rel=\"noopener\">https:\/\/t.co\/6iFcaTPAHt<\/a><\/p>\n<p>\u2014 Perianne (@PerianneDC) <a target=\"_blank\" href=\"https:\/\/twitter.com\/PerianneDC\/status\/1542602434119438338?ref_src=twsrc%5Etfw\" rel=\"noopener\">June 30, 2022<\/a><\/p>\n<\/blockquote>\n<p>In a statement to CNBC, she added that the ruling \u201cat the very least should give regulators pause in attempting to set policies that exceed their congressionally mandated roles, particularly so with emerging innovations with great economic potential.\u201d<\/p>\n<p>Specifically, the industry objects to the SEC\u2019s ruling that virtually all cryptocurrencies are securities subject to its jurisdiction. That has led to enforcement actions that effectively shut down the initial coin offering (ICOs) that funded the growth of the industry during the first major crypto boom in 2017-2018.<\/p>\n<p>It\u2019s an argument that Gensler has been losing recently, after a bipartisan Senate bill recommended giving control of most cryptocurrencies to the Commodity Futures Trading Commission (CFTC).<\/p>\n<p><strong>Read more:<\/strong> <a target=\"_blank\" href=\"https:\/\/www.pymnts.com\/cryptocurrency\/2022\/one-rule-book-for-all-agencies-for-crypto-oversight-sec-chair-says\/\" rel=\"noopener noreferrer\">SEC Chair: All Agencies Regulating Crypto Should Follow \u2018One Rulebook\u2019<\/a><\/p>\n<p><strong>Hostility on Both Sides<\/strong><\/p>\n<p>More recently, the SEC has used the authority it claims to clamp down on the crypto lending industry \u2014 forcing Coinbase to pull back on plans to enter it and getting BlockFi to agree to a $100 million settlement \u2014 with its ongoing refusal to allow a spot bitcoin exchange-traded fund (ETF).<\/p>\n<p>One of the things that outraged Coinbase CEO Brian Armstrong was that the agency would not even explain why it threatened to sue the top crypto exchange if it launched Coinbase Lend, which would have offered customers up to 4% annual yield for deposits.<\/p>\n<p><strong>See also:<\/strong> <a target=\"_blank\" href=\"https:\/\/www.pymnts.com\/cryptocurrency\/2022\/sec-campaign-against-crypto-lending-grows-beyond-coinbase\/\" rel=\"noopener noreferrer\">SEC\u2019s Campaign Against Crypto Lending Grows Beyond Coinbase<\/a><\/p>\n<p>In a July 1 Twitter <a target=\"_blank\" href=\"https:\/\/twitter.com\/jchervinsky\/status\/1542965858233995265\" rel=\"noopener noreferrer\">thread<\/a> about the SEC\u2019s enforcement rulings this year, attorney Jake Chervinsky, head of policy at the Blockchain Association, wrote: \u201cAcross the gov\u2019t, almost everyone is lined up behind the smart national strategy that [President Joe Biden set out in an executive order about crypto regulation] to proceed thoughtfully &amp; act deliberately. And almost everyone gets that only Congress can answer major questions like how to regulate crypto.\u201d<\/p>\n<p>Everyone \u201cexcept the SEC,\u201d he added.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">1\/ On what to expect from the SEC:<\/p>\n<p>Despite all the fears &amp; predictions of a &#8220;regulatory crackdown&#8221; on crypto in the US, &amp; despite historically bad market conditions (to put it lightly), we saw no major gov&#8217;t actions in H1 2022.
