A hacker stole Seth Green\u2019s Bored Ape just weeks before the NFT was set to star in a TV show the Family Guy actor had written about the JPEG. But the show could air even if Green can\u2019t get it back, Jordan Teague<\/a>, co-founder of web3 law firm The Antifirm<\/a>, told The Defiant.<\/p>\n Green said he lost his ape in a \u201cscam GutterCats clone website\u201d on May 17. Someone bought the stolen NFT<\/a> for 106.5ETH (about $210,000), and Green wants it back<\/a> so he can air his new show White Horse Tavern <\/em>without battling his intellectual property rights in court.<\/p>\n But Teague said he needn\u2019t worry: The intellectual property of Green\u2019s Bored Ape wasn\u2019t necessarily transferred away from Green when someone bought his stolen NFT.\u00a0<\/p>\n That\u2019s because everyone who has ever owned the NFT \u2013 including Green, the thief and its new owner \u2013 has IP rights over the NFT, Teague said. According to Teague, Green never lost his intellectual property right to his Bored Ape, even if he no longer controls the NFT.<\/p>\n She said that it\u2019s a good idea for contracts to specify how and when intellectual property ownerships. \u201cThis license specified none of those details [and] \u2018ownership\u2019 of an NFT doesn\u2019t equate to any specific IP rights,\u201d she said.<\/p>\n BAYC\u2019s creator, Yuga Labs, gave token-holders rights to use their artwork however they wanted \u2013 even for commercial pursuits. \u201cWhen you purchase an NFT, you own the underlying Bored Ape, the Art, completely,\u201d <\/em>BAYC\u2019s Terms & Conditions<\/a> states.\u00a0<\/p>\n Green previewed White Horse Tavern<\/em> at VeeCon on Saturday. But if Teague is wrong, his show could be canceled before it even started. Green is trying to get his Ape back, and confirmed<\/a> he had reached the current owner.<\/p>\n Yuga Labs\u2019 other biggest collection is CryptoPunks. CryptoPunk\u2019s creator, Larva Labs, was strict about the rights conferred to holders. When Yuga Labs bought<\/a> the intellectual property rights in March, it granted CryptoPunk holders all commercial rights.<\/p>\n BAYC and CryptoPunks both give their token-holders rights to use their artwork, but some NFT collections like Nouns<\/a> use an even less restrictive license: Creative Commons (CC0).
